Due Diligence Services
  • Phase I Environmental Site Assessments (ESA) to qualify for innocent landowner, contiguous property owner or banafide prospective purchaser under the CERCLA and is a first step in environmental due diligence process.

 

  • Phase II ESAs involve further testing using geophysical equipment and/or susbsurface soil and groundwater sampling and data analyses to conclude whether the environmental media at the site are contaminated compared to applicable regualtory criteria.

 

  • Due Care Plans   - Due care requirements apply to liable and nonliable parties alike and are designed so contaminated properties could be safely redeveloped while preventing

    exacerbation of the existign contamination, unacceptable human exposure and mitigate fire and explosion hazards to allow for the intended use of the facility in a manner that protects the public health and safety, Take reasonable precautions against the reasonably foreseeable acts or omissions of a third party, and provide notifications to the DEQ and others.

  • Baseline Environmental Assessments (BEA) constitue a report (Type "N" BEA, Type "D" BEA and Type "S" BEA based on the natture of contamination and current/future uses of the property) that a new owner of a contaminated property (a "facility" per Part 201 of Michigan PA451), may file with the State of Michigan to relieve the new owner from cleanup liability of the property.
